Andorra : BEPS and mandatory arbitration

In early June Andorra became one of the first countries to sign up to the new Anti-base Erosion and Profit Sharing (‘BEPS’) Multilateral Instrument under article 15 of the BEPS Action Plan at the latest OECD meeting in Paris. Furthermore, in a progressive move indicating Andorra’s commitment to its international obligations, Andorra also committed to the mandatory arbitration provisions. The move was made after approval by the Andorran Council of Ministers earlier in the month.

A total of 69 countries are signatories of BEPS which adds provisions to prevent anti-base erosion and profit shifting to international treaties, however, only 25 nations also committed to accept the provisions on mandatory binding arbitrations which are designed to improve the resolution of international double taxation disputes.
